The terms and conditions below govern the sale of goods from Newebia Ltd ("the Company") to you ("the Customer").
Main Terms
The price payable for the goods/service is set out on the web site or in contract at the time the Customer places their order with us.
When confirmation of an order is received, this is to indicate that the Company has received the Customer's order. It does not indicate that a contract exists between the Customer and the Company. The Company will indicate acceptance of the Customer's order, and hence a contract between the Customer and the Company, when the Company sends the Customer an invoice. The Company have included this term to protect against a mistake in pricing, where the Company has inadvertently under-priced or over-priced goods, or the Company are no longer able to supply a particular product for some reason.
In the case of a change of price, the Company will always contact the Customer first to ensure that the price is acceptable.
If the product is no longer available the Company will seek to offer the Customer a suitable alternative
Tax Charges
All prices shown are in pounds sterling and exclude VAT. (UK sales tax @ 17.5%)
Web Design Terms and Conditions
We reserve the right to refuse to construct a web site which we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws.
The acceptance of a commission shall be deemed as a contractual agreement between the client and Newbeia.
Newebia cannot always guarantee to start work immediately but will arrange a date with the client as to when work can commence.
All material, both text and images, supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
Fixed packages doe not included access or FTP details your free hosting provided in the package. You can cancel your subscription with us but you may be charged a fee if you want to release your website or domain name to another hosting.
The copyright for all material provided by Newebia Ltd, such as HTML code, graphics, photographs and text, will remain the property of Newebia Ltd.
If at any point during the Website Development Cycle a client wishes to cancel, they may do so but will be invoiced an amount that Newebia Ltd judges to be proportional to the amount of work completed on the commission.
Newebia does not undertake to maintain or update a client's website as part of the design commission. If a client wishes Newebia Ltd to maintain or update a web site as a separate commission, Newebia Ltd will negotiate with the client a maintenance contract appropriate to the amount of work required. Web site maintenance may also be undertaken on a time and materials basis if the client so wishes.
The client is responsible for providing accurate copy for all body text. All copy must be provided in an acceptable electronic form. Any subsequent changes to the text requested by the client may be a chargeable ammendment.
Newebia Ltd reserves the right to change or modify any of the terms and conditions contained in the Terms and Conditions.
Abuse Policy - Zero Tolerance
Sending email to people who have not specifically requested it is "spam". Newebia accounts may not to be used to spam! Spamming is a serious offense that Newebia does not permit.
Abusive Usage Includes:
- Sending email to people who have not specifically requested information from you.
- You may not use email lists that are purchased, rented, leased, or in any way bought from a third party.
- Batching or in any way trying to script the addition of new subscribers to the web form subscribe methods.
- Sending unsolicited email thru third parties that then references an account here either in the email or on a landing page of a website.
- Newsgroup or discussion forum postings to off topic newsgroups that prohibit those types of posts.
Violations:
Concerning spam,
"Spamming, or the sending of unsolicited email, using this system, is STRICTLY prohibited.. This action WILL RESULT in immediate termination of your account without refund. Any service interruptions as a result of subscribers spamming will be billed to the subscriber at £65.00 per hour until service is restored. Client will also be subject to legal action."
Newebia Zero Tolerance Policy:
If an Newbeia account is reported or caught violating these terms of service it will be immediately terminated. The customer will not be issued a refund, and will not be given access to any data in the terminated account.
